Senior counsel Vikram Mahajan, appearing for the petitioner Sarwa Mitter, told a Bench comprising Justice P Sathasivam and Justice J S Khehar that the Centre’s continued inaction on the matter posed a challenge to human dignity and violated the fundamental rights of the Indian citizens.
And Mahajan drew the apex court’s attention to the decapitation of one of the slain soldiers, Hemraj, whose severed headed had been taken away by the Pakistani troops. According to the counsel, the brutal and inhuman conduct of the Pakistani forces was a brazen violation of the Geneva Convention. Moreover, he contended that it constituted a serious crime of international concern.
Hence, the need for issuing a direction to the Centre to ask Islamabad to return the martyr’s severed head, Mahajan added.
After briefly hearing the counsel’s submissions, the Bench directed the respondents to file their responses within four weeks.
The Bench tagged the matter with the one filed by father of Kargil martyr Captain Saurab Kalia. Kalia had also encountered brutal torture at the hands of his Pakistani abductors. Mitter said despite the grave provocations the country was having dance and drama festivals with Pakistan. The petitioner also sought a direction to the Centre to break off all sports and cultural ties with Pak.
